Preamble / Acceptance of the conditions of sale

Each order on the Merceriegermaine.com website implies full acceptance of the terms and conditions described here. The customer acknowledges having read them and expressly declares to accept them when clicking on "I have read and accepted the terms and conditions of sale".

The conditions of sale may be subject to change at any time. In this case, the conditions of sale applicable to the order are those in force on the date of the order itself.

Identity

Merceriegermaine.com is owned and operated by Anna Guerra via Antonio della Torre 51, 37030 Mezzane di Sotto, Verona, registered in the commercial register with VAT number 04683590238.

Merceriegermaine.com sells fabrics and articles (ribbons, bias tapes...) by the meter in multiples of 10 cm of length and for fixed width indicated on the site. Merceriegermaine.com also sells all types of products related to sewing and haberdashery.

Merceriegermaine.com sells only online and does not have a physical location open to the public.

The purchase of products through the site will be possible only for the countries indicated in the "Shipping" paragraph.

Articles

Orders for fabrics by the meter will be sent in one piece. If this is not possible, Merceriegermaine.com will notify the customer and confirm the order before preparing it.

Orders for ribbons by the metre will be sent in one piece under 5 metres. Above that, they may be sent in multiple pieces, depending on availability.

Prices

The prices of the items are indicated in Euros (€) and include taxes and duties. The shipping costs of the goods are not included. The total price of the order, shipping costs indicated separately, will always be updated in the cart, until the order is complete.

The prices indicated on the site can change at any time, without any notice. Therefore the prices of the invoiced items are those saved at the time of the order.

Orders / Purchase

To place an order on the Merceriegermaine.com website, registration is required. The customer must indicate an active email address.

The customer will have the opportunity to check all the details of his order and make any changes before confirming and paying.

An automatic electronic delivery message (items, quantities, prices, etc.) will be sent to the customer at the address he/she registered with once the order has been completed.

Payments

At the time of completing the order, the customer is required to choose the payment method between: Bank transfer or Paypal.

The payment of the order is always in advance. Based on the agreements of the customer with his/her bank, additional costs may be charged for the use of the chosen payment instrument. In the case of PayPal, the crediting of the payment of the order will be immediate and Merceriegermaine will proceed immediately to prepare the same.

By validating the order, the customer guarantees that he/she has the authorization and availability to use the chosen payment method, and releases Merceriegermaine.com from any liability.

Merceriegermaine.com reserves the right to suspend any order or delivery in progress if the credit institution has refused payment by credit card or in the event of non-payment.

Merceriegermaine.com reserves the right to refuse or cancel orders placed by buyers it deems unsuitable or with whom it is in a legal dispute regarding a previous order or for any other legitimate reason, without having to provide any justification.

Advance bank transfer

Payment by bank transfer must be made within 3 working days of order confirmation. The reason for the transfer must include the order reference number. The order will be prepared and shipped after receiving the credit on our bank account, on average 3/4 days.

Billing

For each order placed, Merceriegermaine.com issues an invoice for the goods shipped, sending it together with the order, pursuant to Presidential Decree 445/2000 and Legislative Decree 52/2004. The information provided by the customer at the time of ordering is valid for issuing the invoice. No changes to the invoice will be possible after it has been issued. All customer invoices will be available online on the management page of your account.

Shipping, transport and delivery

Shipping costs are the responsibility of the customer. During the ordering process, shipping costs are automatically calculated based on the weight of the items in the cart. All shipping costs include VAT.

Shipping to Italy will be via Poste Italiane, SDA or Nexive. Shipping costs are available in the " Shipping Conditions " section.

Starting from a minimum order of €69.00, shipping costs will be free.

Home delivery

The order will be delivered to the address provided when completing the order form. For security reasons, Merceriegermaine.com cannot ship the purchased products to a PO box or accept any order where it is impossible to identify the recipient of the order and the corresponding address.

Merceriegermaine.com cannot be held responsible for any data entry errors that may cause delays or errors in delivery. In this case, all costs incurred for the return of the order or for new shipment will be entirely borne by the customer.

Delivery time

The delivery time is on average 48 hours to 5 days after receipt of payment. Whatever the chosen shipping method, Merceriegermaine.com will provide the customer as soon as possible with a link allowing them to track the status of their shipment.

Delay in transport or any damage caused by the courier

Merceriegermaine.com is not responsible for delays that are not foreseeable and/or attributable exclusively to the carrier. Any event, such as force majeure, accident, strike, administrative decision or transport stoppage, which could delay or prevent the supply or make its cost exorbitant, constitutes, by explicit agreement, a clause of suspension or termination of obligations for Merceriegermaine.com, without any compensation for the customer. If the event lasts for more than 15 days, the customer will be fully and automatically exonerated from all obligations relating to his order. In the event of problems or delays in delivery, the customer is asked to notify us using the email address servizioclienti@merceriegermaine.com to report the situation.

The order will be shipped in perfect condition, however the customer is requested to check the contents of his order upon delivery and to inform the courier of any damage within and Merceriegermaine.com within two working days at the address customerservice@merceriegermaine.com .

Right of withdrawal

Purchases made on the site are covered by the right of withdrawal guarantee within 10 days of receiving the goods. To exercise the right of withdrawal, the customer must notify Merceriegermaine.com by email to servizioclienti@merceriegermaine.com. This email must contain: order number and refund details (IBAN or Paypal address).

The goods must be returned by registered mail with return receipt, at the customer's expense, to the address:

Returned Products may only be accepted if perfectly intact, without any signs of use, without having been exposed to sunlight or particularly persistent odors, returned in the original packaging or wrapping and accompanied by all original labels.

The refund of the order, excluding shipping costs, will take place after having verified the integrity of the returned material. With the customer's consent, the value of the returned items can be converted into a voucher for the customer that can be used in subsequent orders.

The right of withdrawal does not apply to items that have been customized according to the customer's requests and in particular to fabrics and ribbons sold by the meter.

Order Compliance / Refund in case of product non-compliance

Merceriegermaine.com is responsible towards Consumer Customers, pursuant to articles 130 and 132 of Legislative Decree 206/2005, for any lack of conformity of the products existing at the time of delivery, with particular regard to products resulting defective.

The delivered products must be checked by the customer upon delivery to ensure that they correspond to the products ordered. In the event of anomalies, the customer must notify Merceriegermaine.com by email on the same day of delivery or at the latest one day later to the following address: servizioclienti@merceriegermaine.com. Any complaint after this deadline will not be accepted.

In the event of a lack of conformity of a product, the customer has the right to exercise the provisions in his favor of the Consumer Code and to request the conformity of the delivery of the order, or in the event of any unavailability of the products ordered which has occurred in the meantime, to cancel the order, by contacting Merceriegermaine.com by email at the following address: servizioclienti@merceriegermaine.com.

Any refund of the price will be made only if the non-conformity of the order is confirmed by Merceriegermaine.com and if the returned products are perfectly intact, without any signs of use, without having been exposed to sunlight or to particularly persistent odors.

The refund of the order, including shipping costs, will take place after having verified the integrity of the returned material. With the customer's consent, the value of the returned items can be converted into a purchase voucher for the customer that can be used in subsequent orders.

If the customer cannot return the goods received in full or if they are returned in deteriorated condition, Merceriegermaine.com will retain the equivalent value from any refund.

Applicable law and competent court

These General Conditions are governed by Italian law and must be interpreted in accordance with Italian law. For any disputes regarding these Conditions of Sale, the competent court is Verona.

The personal data requested by Merceriegermaine.com will be used exclusively for internal purposes and processed in order to satisfy the requests expressed by the customer and will not be transferred to third parties under any circumstances or for any reason.

The customer has the right to withdraw consent to the processing of personal data at any time by sending a written communication to the registered office of Merceriegermaine.com.

The customer, who declares to have received the information pursuant to art. 13 and on the rights to which he is entitled, pursuant to art. 7 of Legislative Decree no. 196/2003, has the right to access his data according to the methods provided therein.

Marketing communications will be sent only with the explicit consent of the customer given together with the authorization to process data and sending in the online registration form.
